Terms of Use for TwoDown

These Terms of Use ("Terms") govern your access to and use of the TwoDown mobile application and related services (collectively, the "Service") operated by TwoDown ("TwoDown", "we", "our", "us").
By creating an account or using the Service, you agree to these Terms and our [Privacy Policy](https://twodownapp.com/privacy). If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use TwoDown. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian who accepts these Terms on your behalf.
You must provide accurate account information and keep it up to date. You are responsible for activity that occurs under your account.
2. What TwoDown Is — and Is Not
TwoDown is a rider community app designed to help motorcyclists and other riders discover pass-by encounters, connect with other riders, chat (including group and ride-event chats), coordinate group rides and routes, and use optional safety tools.
TwoDown is not:
- An emergency dispatch or 911 replacement service.
- A medical service or source of medical advice.
- A live rider-tracking or open people-search product.
- A turn-by-turn navigation product or a guarantee of route, map, or traffic accuracy.
- A guarantee of safe riding conditions, safe meetups, or trustworthy users.
You are solely responsible for your riding decisions, meetups, and compliance with traffic laws and local regulations.
3. Your Account
You may register with an email address and password, or through Sign in with Apple or Google Sign-In where available. You agree not to share your login credentials or session access, impersonate others, create accounts for abusive purposes, or use the Service if we have suspended or terminated your account.
We may suspend or terminate accounts that violate these Terms, create risk for other users, or harm the Service.
4. Community Standards and Acceptable Use
You agree to use TwoDown respectfully and lawfully. You will not:
- Harass, threaten, stalk, abuse, or discriminate against others.
- Post or send unlawful, fraudulent, hateful, sexually exploitative, or violent content.
- Use the Service for spam, scams, unauthorized advertising, or impersonation.
- Misuse emergency beacons (including false, prank, or non-emergency activations) or misuse medical profile information.
- Harass or spam others through group chats, ride-event chats, co-rider connect, rosters, reactions, or ride-event comments.
- Attempt to bypass blocks, privacy controls, encounter rules, nearby-beacon opt-in settings, or subscription limits.
- Scrape, reverse engineer, or interfere with the Service except where prohibited by law.
- Upload malware or attempt unauthorized access to our systems or other users' accounts.
- Use contact discovery, QR connect, messaging, co-rider connect, or ride events to solicit users for unrelated commercial purposes without permission.
We may remove content, restrict features, or terminate accounts to enforce these rules. We do not guarantee pre-moderation of all user content.
5. Encounters, Location, and Privacy Features
TwoDown's core experience depends on optional location features and pass-by encounter detection. By enabling proximity ingestion and granting location permissions, you authorize us to process location data as described in our Privacy Policy.
Encounter cards use privacy controls such as delayed visibility and blurred region labels. Other users do not receive your continuous live location through normal encounter features.
You control several privacy settings in the app, including whether to appear in the encounter deck, whether social links are shown, whether encounter regions are blurred, whether verified users may discover you through contact matching, and whether to receive nearby emergency beacon alerts.
6. Connections, Messaging, Ride Events, and QR Connect
Connections are intended to follow real-world encounters or explicit invite flows (for example QR connect, contact discovery, or co-rider connect on a shared ride event where available). You are responsible for what you share in profiles, direct/group/ride-event chats, reactions, ride events, comments, attachments, shared locations, and routes.
When hosting or joining ride events, you are responsible for your own safety planning, including choosing public meetup points, reviewing any shared route, and informing trusted contacts of your plans. Ride-event details, participant rosters, and uploaded or drawn routes (for example GPX files) may be visible to people who can view the event. Route snapping and map display are approximate aids only—not professional navigation guidance.
7. Emergency Beacon and Medical Information
7.1 Emergency beacon
The emergency beacon feature lets you deliberately alert selected riders with your live location and optional note. Call local emergency services (for example 911, 112, or 999) when you need immediate professional emergency response. TwoDown does not dispatch police, ambulance, or roadside rescue services.
Depending on options available to you, recipients may include your connections, selected ride-event participants, and/or nearby riders who have opted in to nearby beacon alerts. Nearby matching depends on proximity settings and recent location telemetry; we do not guarantee that any nearby rider is available or will respond.
Beacon alerts depend on network connectivity, device battery, recipient availability, opt-in settings, and user response. We do not guarantee that any recipient will see, respond to, or reach you in time.
Activating a beacon is a temporary exception to TwoDown's normal location privacy. Recipients you alert can see live location updates while the beacon is active. Use beacons only for genuine safety needs.
7.2 Medical / ICE profile (TwoDown Pro)
If you choose to add a medical or in-case-of-emergency profile, you represent that the information is accurate to the best of your knowledge. It is shared only with beacon recipients while you have an active beacon. It is not a medical record and must not be relied on as a substitute for professional medical care or emergency services.
8. Invite Friends and Contact Discovery
If you use phone verification or contact matching:
- You must only verify a phone number you control.
- You must have a lawful basis to use contact information you upload or hash for matching.
- Other users can find you only if you opt in to discoverability and they perform a matching lookup.
We provide tools to invite non-users through your device's share sheet; you are responsible for how you contact people outside the app.
9. TwoDown Pro Subscriptions
Some features require an active **TwoDown Pro** subscription (for example larger ride groups, co-rider connect, medical/ride-group beacon extras, and a public Pro badge, depending on your region and current feature set). During early access periods, we may unlock some or all Pro features for free; subscription terms below apply when paid Pro is available in your region.
9.1 Billing
Purchases are processed by Apple (App Store) or Google (Google Play) through RevenueCat. Prices, billing periods, and taxes are shown before purchase. Payment is charged to your app store account.
9.2 Auto-renewal
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
9.3 Managing and canceling
You can manage or cancel subscriptions in your Apple or Google account subscription settings. Deleting the TwoDown app does not cancel a subscription.
9.4 Refunds
Refund requests are handled by Apple or Google under their policies. TwoDown does not control app store refund decisions.
9.5 Changes to Pro features
We may add, modify, or retire Pro features over time. If a change materially reduces core paid functionality, we will take reasonable steps permitted by app store rules to notify affected subscribers.
10. User Content and License
You retain ownership of content you submit (for example profile text, photos, messages, reactions, group and ride-event chat content, ride details, routes/GPX files, and beacon notes). You grant TwoDown a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your content solely as needed to operate, improve, and secure the Service.
You represent that you have the rights to the content you upload and that it does not violate these Terms or others' rights.
11. Our Intellectual Property
TwoDown, its branding, software, and design elements are owned by TwoDown or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks except as necessary to use the Service.
12. Safety Reporting, Blocking, and Enforcement
You may block, mute, or report users and messages. We may investigate reports and take action at our discretion, but we do not guarantee outcomes or response times.
13. Account Deletion
You may delete your account in Settings. Deletion is intended to permanently remove account access and initiate removal of associated data as described in our Privacy Policy. Some content may remain where it is part of another user's experience (for example messages others sent in a shared thread). Some records may also be retained by us, app stores, or payment processors where required by law or for legitimate operational needs.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL CONTENT; THAT ENCOUNTERS WILL BE ACCURATE; THAT ROUTES, MAPS, OR ROAD-SNAPPING WILL BE ACCURATE OR SAFE TO FOLLOW; THAT BEACON ALERTS (INCLUDING TO CONNECTIONS, RIDE GROUPS, OR NEARBY OPTED-IN RIDERS) WILL REACH RECIPIENTS OR PROMPT A RESPONSE; OR THAT ANY USER IS WHO THEY CLAIM TO BE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TWODOWN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TWODOWN FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
16. Indemnification
You agree to defend, indemnify, and hold harmless TwoDown and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your interactions with other users, or your violation of these Terms or applicable law.
17. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If we make material changes, we will provide notice through the app, by email, or on [https://twodownapp.com/terms](https://twodownapp.com/terms). Continued use after the effective date of updated Terms constitutes acceptance, except where applicable law requires otherwise.
18. Governing Law and Disputes
These Terms are governed by the laws applicable where TwoDown operates, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country require otherwise.
Before filing a claim, you agree to contact us at support@twodownapp.com and attempt to resolve the dispute informally.
19. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
